For a residential month-to-month tenancy without a specific duration, the current Florida rule is at least 30 days' written notice before the end of a monthly period. Older materials may show 15 days.
Check the kind of tenancy
Section 83.57 addresses termination of a tenancy without a specific duration. Its notice periods are:
- Year to year: at least 60 days before the end of an annual period.
- Quarter to quarter: at least 30 days before the end of a quarterly period.
- Month to month: at least 30 days before the end of a monthly period.
- Week to week: at least 7 days before the end of a weekly period.
The statute also specifies written notice delivered in the manner provided by section 83.56(4). Do not confuse ordinary termination of this tenancy with nonpayment, another lease violation, a fixed-term lease, or an eviction procedure.
