Definition: Commingling is improperly mixing money entrusted to you with your own personal or business funds.
Example
A broker deposits a customer’s earnest-money check into the brokerage’s ordinary operating account instead of the proper escrow account.
Keep the distinction clear
Commingling concerns mixing funds; conversion concerns unauthorized use or control. Florida permits limited personal or brokerage funds in specified escrow accounts—up to $1,000 in a sales escrow account and $5,000 in a rental distribution escrow account. That allowance does not permit spending customer money.
