Definition: A freehold estate is an ownership interest in real property whose duration is not fixed by a definite calendar ending date. Examples include fee-simple estates and life estates.
Example
An owner holds a home in fee simple. Another person holds a life estate that lasts for a specified person’s lifetime. Both are freehold estates.
Keep the distinction clear
A life estate can end, even though its ending date is not known in advance. Freehold does not mean “mortgage-free”: a Florida owner can hold a freehold estate subject to a mortgage lien.
