Definition: An encroachment is an unauthorized physical intrusion from one property onto another, such as part of a structure extending across a boundary.
Example
A survey shows that a neighbor’s garage extends two feet beyond the property line. That extension is an encroachment.
Keep the distinction clear
An encroachment describes the physical intrusion; an easement describes a legal right. A fence’s location does not by itself establish the legal boundary or prove that permission exists.
