Definition: Deed restrictions are private limits on property use established through a deed or other governing instrument, often called restrictive covenants.
Example
A valid recorded restriction limits a subdivision lot to residential use. A proposed commercial workshop must be evaluated against that restriction as well as applicable government rules.
Keep the distinction clear
Private restrictions and zoning come from different sources. Government permission does not automatically override a valid private restriction. A restriction’s wording, duration, and enforceability must be considered; an old recorded restriction is not automatically enforceable.
