Definition: An express contract has terms communicated in words, whether written, spoken, or a combination of both.
Example
An owner and a painter state the work, price, and completion date in a written agreement.
Keep the distinction clear
Express does not mean every oral agreement is enforceable. A contract covered by the Statute of Frauds must satisfy its writing requirements unless an applicable exception applies.
