An attorney who is an active member in good standing with The Florida Bar receives two specific Florida real-estate education exemptions. The attorney exemption is not a blanket waiver of every real-estate course or licensing requirement.
DBPR determines whether you qualify. Confirm your current Florida Bar status and the requirements attached to your application or renewal with DBPR before skipping, buying, or beginning a course. TSRE cannot approve the exemption.
What a qualifying Florida attorney is exempt from
Sales associate pre-licensing
An active Florida Bar member in good standing who is otherwise qualified is exempt from the 63-hour sales associate pre-licensing course. The DBPR RE 1 application instructs the attorney to include the Florida Bar number and related information.
Regular continuing education
Section 475.451(6), Florida Statutes, exempts a qualifying Florida attorney from the regular continuing-education requirements in Chapter 475.
What Florida Bar membership does not waive
Florida Bar membership alone does not waive:
- the 72-hour broker pre-licensing course;
- the 45-hour sales associate post-licensing requirement;
- the 60-hour broker post-licensing requirement;
- the sales associate or broker experience requirements;
- the applicable Florida state examination;
- the application, fees, fingerprints, or background review;
- the minimum age, high-school diploma or equivalent, or Social Security number requirements; or
- license activation and other noneducation requirements.
DBPR's education page specifically states that attorneys are not exempt from post-licensing education.
Applying for a sales associate license as a Florida attorney
- Verify that the Florida Bar lists you as active and in good standing.
- Review the current DBPR sales associate application and exemption instructions.
- Include the Florida Bar number and requested information.
- Ask DBPR to confirm that the 63-hour prerequisite is marked exempt.
- Complete the remaining application, fingerprinting, examination, and activation requirements.
If you want a Florida broker license
Attorney status does not create a separate broker-course exemption. A broker applicant must meet the broker experience requirement and complete the 72-hour broker pre-licensing course unless a different DBPR-approved exemption—such as a qualifying four-year degree in real estate—or another approved licensing route applies.
