For exam study, distinguish the state department, the real estate commission, its supporting division, and the written rules. Then identify the kind of regulatory power a question describes.
Agencies, rules, and powers
FREC, DBPR, and DRE: who does what?
| Name | Role |
|---|---|
| DBPR — Department of Business and Professional Regulation | The state department that regulates many professions, including real estate. |
| FREC — Florida Real Estate Commission | The commission with real estate regulatory powers granted by law. |
| DRE — Division of Real Estate | The division providing administrative and support services for real estate regulation. |
| 61J2 — Florida Administrative Code rule division | The location of FREC rules; it is not a separate agency. |
Sections 475.02, 475.021, and 475.03 establish the commission and division and describe services and delegation. For exam study, separate the department, commission, division, and written rules.
Three types of FREC powers
| Power | Study meaning | Example |
|---|---|---|
| Executive | Carry out and administer the regulatory law. | Administer licensing and education responsibilities within statutory authority. |
| Quasi-legislative | Adopt rules under authority granted by the Legislature. | Adopt a rule implementing an education requirement. |
| Quasi-judicial | Decide administrative matters and impose authorized discipline. | Enter a disciplinary order after the applicable process. |
“Quasi” means the function resembles lawmaking or judging within the commission’s limited authority. FREC does not enact Florida statutes or sentence someone to jail. Section 475.05 addresses rulemaking, and section 475.25 addresses discipline. The Course I syllabus, Section 3, includes the three categories of powers.
Statutes versus rules: how much should I memorize?
The Legislature enacts statutes; agencies adopt rules under delegated authority. Study the syllabus objectives and their practical application: who must act, what must happen, the deadline, and the exception. Learn the chapter or rule references emphasized in your course, but do not replace understanding with memorizing every paragraph of a law book.
Example: “Who adopts an implementing rule?” tests quasi-legislative authority. “Which source contains FREC rules?” points to 61J2. “Can FREC impose a license suspension through the disciplinary process?” tests quasi-judicial authority. The wording tells you whether the question is asking for an organization, a legal source, or a type of power.
