A BAR SALE is a memory aid for eight real estate activities. Learn the activity behind each letter, then ask who is doing it, for whom, and for what compensation. The acronym alone does not decide whether a license is required.
What each letter means
| Letter | Activity | Example |
|---|---|---|
| A | Appraise | Estimate a property’s value, within the limits of the license and applicable appraisal law. |
| B | Buy | Help a buyer locate and negotiate for property. |
| A | Auction | Offer real property through an auction. |
| R | Rent | Help an owner find a tenant for rental property. |
| S | Sell | Market and negotiate a property sale for an owner. |
| A | Advertise | Advertise or hold out brokerage services to the public. |
| L | Lease | Negotiate a lease for an owner or prospective tenant. |
| E | Exchange | Arrange a trade of one property interest for another. |
Apply the licensing test
Section 475.01(1)(a), Florida Statutes describes brokerage activity performed for another person for compensation or with an expectation of compensation. Offers, attempts, and negotiations can count; a successful closing and a paid commission are not always necessary. Read the exemptions in section 475.011 before concluding that a particular person needs a license.
Example: Jordan offers to find a buyer for a neighbor’s land in return for a fee if it sells. The promised fee matters even before a buyer is found. By contrast, an owner selling the owner’s own property is generally within an owner exemption, subject to the statute’s conditions.
Common mix-ups
- B means buy, not build. Building may involve separate contractor licensing, but it is not the B in this memory aid.
- L means lease, not license. A license is the credential; leasing is an activity.
- Rent and lease overlap. Do not invent a legal rule that one always means short term and the other always means long term.
- A sales associate works through the registered employer. Memorizing these services does not authorize an associate to operate an independent brokerage.
Does “appraise” make every licensee a certified appraiser?
No. A real estate license is not an appraiser certification. Separate appraisal requirements and restrictions can apply, including requirements for federally related transactions. For the distinction between a pricing analysis and an appraisal, see CMA and appraisal concepts.
Try three practice questions
- What does the B stand for: buy, build, or borrow?
- A person offers to negotiate a neighbor’s sale for a promised fee, but the sale never closes. Does the lack of a closing automatically remove the licensing issue?
- Does a Florida sales associate license automatically authorize every appraisal assignment?
Answers and explanations
- Buy. Match the letter to the real estate activity.
- No. An offer or attempt for another with expected compensation can fall within the brokerage definition; check any applicable exemption.
- No. Appraisal credentials, assignment requirements, and the limits of the person’s license still matter.
