A property advertisement must identify the licensed brokerage firm. An agent’s personal name, team nickname, or telephone number does not replace that requirement.

Start with Rule 61J2-10.025
The current Florida advertising rule requires advertising to make clear that the public is dealing with a real estate licensee, include the licensed brokerage name, and avoid false or misleading content. If the licensee’s personal name appears, the rule requires at least the last name as registered with FREC.
For Internet advertising, place the brokerage name adjacent to, immediately above, or immediately below the contact information. That includes information such as a phone number, email address, or physical address. The DBPR advertising handout reproduces these requirements.
Read the exact requirement being tested
| Question asks about… | Focus on… |
|---|---|
| An advertisement for a listed property | The licensed brokerage name and truthful identification. |
| The agent’s name in an advertisement | At least the last name as registered with FREC. |
| An online ad with contact information | The brokerage name’s placement next to, just above, or just below that contact information. |
| An office entrance sign | The separate office-sign requirements, including the applicable broker wording. |
The advertising rule does not universally require the brokerage telephone number in every ad. Do not substitute a familiar marketing practice for the exact rule asked in an exam question.
Original example
A fictional online ad says “Call Jordan at 555-0100 for this three-bedroom home” and omits the licensed brokerage name. The phone number does not cure the missing brokerage identification. A corrected version places the licensed firm name beside the contact information and uses the registered last name if Jordan’s personal name is included.
Do not assume that a logo somewhere else on a website fixes every individual ad. Review the actual ad and contact placement.
Keep related rules separate
Office entrance signs have their own requirements. Team or group advertising is also governed by Rule 61J2-10.026. Actual advertising may involve additional fair-housing, brokerage, platform, and other requirements. Have the supervising broker review it.
Try three practice questions
- An ad has the agent’s cellphone number but no licensed brokerage name. Does the phone number satisfy the brokerage-name requirement?
- The agent’s personal name appears. What is the minimum personal-name requirement in Rule 61J2-10.025?
- An online ad places contact information in one area and the brokerage name far away in an unrelated area. What placement rule should you check?
Answers and explanations
- No. The licensed brokerage name must appear.
- The last name as registered with FREC. Do not confuse that minimum with a separate office or branding policy.
- Adjacent to, immediately above, or immediately below the contact information. Review the placement in the actual ad.
