The borrower gives the mortgage; the lender receives it as security. Separate the promise to pay, the mortgage lien, and ownership before interpreting a loan clause.
Mortgagor vs. mortgagee: who is the borrower?
In a basic mortgage question, the mortgagor is the borrower and the mortgagee is the lender. The borrower receives the loan money but gives the mortgage as security. That is why following the money alone can lead you to reverse the terms.
| Term | Role | What to remember |
|---|---|---|
| Mortgagor | The property owner giving the mortgage; ordinarily the borrower in an exam example. | Gives the lender a security interest in the property. |
| Mortgagee | The lender receiving the mortgage as security. | Holds the mortgage lien; lending the money does not make it the homeowner. |
| Promissory note | The borrower's written promise to repay the debt. | Look here for the repayment obligation and loan terms. |
| Mortgage | The instrument securing the debt with the property. | Distinguish the security from the promise to pay. |
Memory cue: the mortgagor gives the mortgage; the mortgagee receives it. See HUD's glossary of mortgage terms and the CFPB guide to notes and mortgage documents.
Does the bank own my Florida home until I pay it off?
No. Florida follows lien theory. Under section 697.02, a mortgage creates a lien; it does not transfer legal title or possession to the lender. A homeowner can hold a freehold estate while still owing a mortgage. Having debt does not turn the owner into the bank's tenant.
The lien gives the lender security and potential foreclosure remedies if the obligation is not met. It does not make the lender the owner merely because money remains owed. Full payoff releases the mortgage security; it is not the first moment the borrower becomes an owner. For the ownership-versus-tenancy distinction, see freehold and leasehold estates.
Practice: identify the person, document, or interest
- Maya buys a Florida home, takes title, and borrows from Harbor Bank. Who is the mortgagor, and who is the mortgagee?
- Maya still owes most of the loan. Does that fact alone make her interest a leasehold?
- A question asks which document contains the promise to repay. Is the best answer the note or the mortgage?
Answers and explanations
- Maya is the mortgagor; Harbor Bank is the mortgagee. Maya gives the mortgage as security for the bank's loan.
- No. Mortgage debt and the type of ownership estate are separate issues.
- The promissory note. The mortgage secures the debt with the property.
